• What your rights are regarding the data processed by New Well and how you can exercise these rights,

A- Can we process your personal data as New Well?

We process some of your data to provide the services offered to you within the scope of the Personal Data Protection Law No. 6698 ("KVKK").

Due to our responsibility for determining the purposes and means of personal data processing and for establishing and managing the data recording system, we have certain responsibilities and obligations as a "data controller" within the scope of KVKK.

As the data controller, we may process your personal data lawfully and respectfully of your personal rights, provided that you have explicit consent or if there are exceptions specified in Article 5/2 of the KVKK.

B- Which Personal Data Do We Process?

We process your personal data in compliance with KVKK, other legislation, and international regulations, and with the aim of providing you with better service, for the following purposes:

To carry out and complete your order processes and ensure communication with you; to provide you with information about products, services, campaigns, and promotions; to conduct statistical analyses related to your shopping preferences,

For the purpose of fulfilling our legal obligations arising from relevant legislation, including the Law on Regulation of Publications Made on the Internet and Combating Crimes Committed Through These Publications No. 5651, the Law on Regulation of Electronic Commerce No. 6563, the Turkish Penal Code No. 5237, and the Personal Data Protection Law No. 6698 and the secondary legislation of the relevant laws, we process certain data that directly or indirectly identifies the Member, such as your name, surname, email address, phone number, gender, date of birth, Turkish ID number, tax ID number, billing and delivery addresses, and if you link your membership with social media accounts.

In addition to this data, we collect and process the frequency and times of Site visits, order placement times, IP address at the time of order, your shopping history, and payment method to analyze and understand visitor behavior and preferences.

We process and store these personal data, based on your explicit consent, for you to benefit from the services we offer on the Site, or when it is directly related to the establishment or performance of the contract we have with you, or when data processing is mandatory for our legitimate interests, provided that it does not harm your fundamental rights and freedoms, and by taking appropriate information security measures, without using it outside the purposes and scope determined by this KVKK Information Text.
We use some of the data we collect in the data bank for periodic campaign activities, special promotional activities for customer profiles, and to prevent unwanted emails, in accordance with relevant legal regulations.

We may share your personal data with third parties with whom we collaborate to provide our services (such as shipping, delivery, etc. companies) and with government authorities as required by our legal obligations. New Well may share your personal data and browsing information related to your visit to the Site or membership with public institutions and organizations authorized to request such information legally for your security and for New Well to fulfill its obligations under the law. However, we will not use your personal data for any commercial purpose or share it with third parties, except for the activities listed above and in cases required by relevant legislation.

C- What are your Rights and Obligations Regarding Your Personal Data?

Your Rights as a Data Subject as Listed in Article 11 of the KVKK;

As a personal data owner, you have the right to:

• Learn whether your personal data is being processed,
• Request information if your personal data has been processed,
• Learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
• Know the third parties to whom your personal data is transferred domestically or abroad,
• Request the correction of your personal data if it is incomplete or incorrectly processed and request that the transaction made in this context be notified to third parties to whom your personal data has been transferred,
• Request the deletion or destruction of your personal data if the reasons requiring its processing have disappeared, despite being processed in accordance with the KVKK and other relevant laws, and request that the transaction made in this context be notified to third parties to whom your personal data has been transferred,
• Object to the emergence of a result against the person by analyzing your processed data exclusively through automatic systems,
• Demand compensation for your damages if you suffer damage due to unlawful processing of your personal data.

D- How Long Is Your Personal Data Stored?

In accordance with the Law on the Regulation of Electronic Commerce No. 6563; records regarding the withdrawal of consent will be stored for 1 year from this date; the content of commercial electronic messages and all other records related to the shipment will be stored for 3 years to be presented to the relevant ministry when necessary. After the expiration of this period, your personal data will be deleted, destroyed, or anonymized by our company or upon your request.

E- What are our obligations as New Well in protecting your personal data?

As we process your personal data as a data controller, we have certain obligations under the KVKK and other relevant legislation.

These obligations can be listed under the following headings:

• Obligation to notify,
• Obligation to ensure data security,
• Obligation to register with the Data Controllers Registry.

F- Commercial Electronic Communication Consent

You will be contacted via the electronic communication addresses (SMS, e-mail) obtained through www.newwell.com.tr to make various announcements regarding the products and services provided by New Well. In this context, if you request to receive commercial electronic messages;
